Terms of Service

1. Service Description
Card Calendar ("the Service") is an automated card-sending platform operated by Card Calendar Ltd ("we", "us", "our"). The Service helps you manage occasions, select or upload card designs, personalise messages, and arrange for physical or digital card delivery to your contacts.
2. Subscription Terms
Subscriptions are billed annually. Each plan includes a card allowance per year. Additional cards may be purchased on a per-card basis. Subscriptions auto-renew at the end of each billing period unless cancelled. Prices are shown inclusive of VAT where applicable.
3. Cancellation
You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to the Service until the end of your current billing period. No partial refunds are given for unused time within a billing period, except as required by law (see section 4).
4. Refunds and Cooling-Off
In accordance with the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a 14-day cooling-off period from the date of purchase. During this period, you may request a full refund. If you have used the Service during the cooling-off period (for example, by sending a card), we may deduct a proportionate amount for the service already provided. 5. Card Delivery
We arrange for card printing and postal delivery on a best-effort basis through our fulfilment partners. Delivery times are estimates and we cannot guarantee specific delivery dates. We are not liable for delays caused by postal services, incorrect addresses provided by you, or circumstances beyond our reasonable control. If a card is lost in the post, we will reprint and resend it at no additional cost.
6. User-Uploaded Content
By uploading designs, images, or other content to the Service, you grant Card Calendar a non-exclusive, worldwide, royalty-free licence to reproduce, print, and distribute your content solely for the purpose of card fulfilment. You retain all ownership rights to your content. This licence terminates when you delete the content or your account. You represent and warrant that you have all necessary rights and permissions for any content you upload.
7. Designer Commission Terms
If you participate in our designer marketplace, you will earn a commission of 20p per card use of your designs. The minimum payout threshold is £5. Payouts are processed within 5 working days of reaching the threshold, via the payment method registered in your designer account. Commission rates may be updated with 30 days' notice.
8. Prohibited Content
You must not upload, create, or send content that is:
- Offensive, abusive, threatening, or hateful.
- Illegal or promotes illegal activity.
- Copyrighted material used without the rights holder's permission.
- Harmful, including malware, phishing attempts, or deceptive content.
- Pornographic or sexually explicit.
We reserve the right to remove any content that violates these terms and to suspend or terminate accounts that repeatedly breach this policy.
9. Limitation of Liability
To the fullest extent permitted by law, our total liability to you for any claims arising from or related to the Service shall not exceed the amount you have paid to us in the 12 months preceding the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
10. Intellectual Property
All intellectual property rights in the Service, including the software, design, and branding, belong to Card Calendar Ltd. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose during your subscription.
11. Changes to These Terms
We may update these terms from time to time. We will notify you of any material changes by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated terms.
12. Governing Law
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
